Terms & Conditions

Back to main website

Last updated: October 2026

These Terms and Conditions (“Terms”) apply to orders placed by consumers through the NOCHme online shop and to the related services provided by Marketiger B.V., BIC 1, 5657 BX Eindhoven, The Netherlands, Chamber of Commerce number 73730262 (“Marketiger”).

Marketiger provides on-demand digital manufacturing services. Products are manufactured in response to individual Customer orders and are generally not produced or held as finished stock for general resale.

For the purposes of these Terms, a “Consumer” means a natural person acting primarily for purposes outside their trade, business or profession.

1. Services and Orders

Marketiger provides on-demand 3D printing, manufacturing, fulfilment and related services.

By placing the products in the online shop, Marketiger makes a binding offer to enter into a contract regarding those products. The Customer may place products in the shopping basket without obligation and amend entries at any time prior to submitting the binding order by using the correction facilities provided for this purpose and explained during the ordering process.

The contract is formed when the Customer clicks the order button indicating acceptance of Marketiger's offer concerning the products contained in the shopping basket. Once the Customer has submitted the order, an order confirmation will immediately be sent by email.

Marketiger may refuse, suspend or cancel an order that cannot reasonably be manufactured or fulfilled or that Marketiger reasonably believes may violate applicable law or third-party rights.

2. Contract Language and Contract Information

The languages available for concluding the contract are German and English.

Marketiger saves the text of the contract and provides the Customer with the order data and applicable Terms and Conditions on a durable medium, for example by email.

For security reasons, the stored contract text may not remain accessible via the internet.

3. Customer Files and Printability

The Customer is responsible for the correctness and completeness of all submitted photographs, images, models, textures, colors, dimensions, geometry, specifications and other content or design elements.

Marketiger uses reasonable efforts to identify apparent technical issues that may prevent submitted content from being manufactured successfully.

This is a production-oriented review and not an approval or verification of the Customer's content or design.

A file may be technically suitable for processing while still containing unintended colors or textures, missing or incorrect elements, incorrect dimensions, unusually thin or fragile features, insufficient wall thicknesses or other issues.

Marketiger cannot determine whether such characteristics are intentional and does not guarantee that all design or structural issues will be identified before production.

Where Marketiger identifies an apparent problem, it may contact the Customer or place the order on hold for clarification. Failure by Marketiger to identify an issue does not transfer responsibility for the Customer's submitted content or design to Marketiger.

4. Prices and Payment

The prices displayed in the online shop apply to Consumer orders and include applicable VAT where required.

Delivery costs may apply in addition to the displayed product price. Further information on delivery costs, if applicable, is provided within the relevant product offer and/or during the ordering process.

5. Production Time

Marketiger's average production time is approximately 10 working days, unless otherwise agreed.

Production times are estimates and may vary depending on order volume, specifications, materials, production capacity and other operational circumstances.

Production time does not include shipping or transit time. A specific or guaranteed deadline applies only when expressly agreed by Marketiger.

6. On-Demand Production, Changes and Cancellation

Marketiger manufactures products on demand according to the individual Customer's submitted photographs, images, designs, selections or other specifications.

Products therefore generally cannot simply be returned to stock or sold to another customer.

Cancellation or modification may no longer be possible once Marketiger has started processing an order for production. Processing may include image or AI-assisted processing, creation or preparation of production files, nesting, slicing, combining the order with other production data, preparation of a production batch or physical manufacturing.

Before this stage, the Customer may request cancellation or modification. Marketiger will use reasonable efforts to accommodate such a request, but the cancellation or modification becomes effective only after confirmation by Marketiger.

Mandatory statutory Consumer rights remain unaffected.

7. Consumer Right of Withdrawal

Consumers have a statutory right of withdrawal where required by applicable law.

The statutory right of withdrawal may not apply to products made according to the Consumer's specifications or which are clearly personalized.

NOCHme products are individually produced using Customer-supplied photographs, images, selections or other personal specifications and will therefore generally constitute personalized products.

Where the statutory exception applies, the Consumer has no statutory right of withdrawal for that product.

Marketiger will provide Consumers with the applicable statutory information concerning withdrawal rights as required by law.

8. Manufacturing Quality and Tolerances

3D printing is subject to the technical characteristics and tolerances of the applicable manufacturing process.

Reasonable variations may occur in color, color intensity, dimensions, surface finish, texture, production orientation and other characteristics. Colors shown on screens, AI-generated previews, renders or photographs may differ from the physical product.

Products may also discolor or otherwise change in appearance over time due to material characteristics, environmental conditions or exposure to light.

These reasonable manufacturing variations do not in themselves constitute a defect unless specific tolerances or requirements have expressly been agreed.

9. Product Use and Safety

Unless expressly agreed otherwise in writing by Marketiger, all 3D-printed products supplied by Marketiger are intended for display and decorative purposes only.

Due to the materials and manufacturing processes used, the products do not qualify as toys, are not suitable for use as toys and are not intended for use by minors, including children.

Customers must not provide products manufactured by Marketiger to minors for use as toys or play objects.

3D-printed products may be delicate and may break, crack, deform, melt, discolor or otherwise become damaged if handled incorrectly or exposed to unsuitable conditions.

Unless expressly confirmed otherwise by Marketiger, products are not intended for food contact, medical use, safety-critical applications or other regulated or specialized applications.

10. Delivery

Delivery Costs

Delivery costs may apply to the product prices displayed. Further information on delivery costs, if applicable, is explained within individual product offers.

Delivery Options

Marketiger ships the products to the delivery address specified in the order process.

Marketiger only dispatches goods en route; pick up by the Customer is not possible.

Marketiger does not deliver to a "Packstation."

Marketiger uses third-party postal, courier, freight and logistics providers. Shipping and transit times are estimates unless a guaranteed delivery service or deadline has expressly been agreed.

The Customer is responsible for providing complete and accurate delivery information.

Where applicable, customs duties, import taxes or similar destination charges are borne by the Customer unless otherwise stated.

Mandatory Consumer rules regarding transfer of risk remain unaffected.

11. Damage During Delivery, Inspection and Claims

If goods are delivered with obvious damage caused during delivery, the Customer is requested to report the defect to the carrier and notify Marketiger without delay.

Failure to make a complaint or contact the carrier or Marketiger does not affect the Customer's statutory rights or the enforcement of such rights, including statutory warranty rights. Such notification assists Marketiger in asserting its own claims against the carrier or transport insurer.

Customers should inspect products promptly after delivery and report any apparent defect, damage, missing item or incorrect product as soon as reasonably possible, preferably within 7 days after receipt.

Claims should include the relevant order information and, where appropriate, photographs.

A product manufactured in accordance with the Customer's submitted content is not considered defective solely because that content contained a design, color, texture, dimensional or structural issue that was not identified by Marketiger before production.

12. Warranty and Guarantees

Liability for Defects

Marketiger is under a legal duty to supply products that are in conformity with the contract.

Subject to the manufacturing characteristics and tolerances described in Article 8, the statutory guarantee provisions (liability for defects) apply.

With respect to Consumers, statutory warranty rights governed by the law of the country where the Consumer has their habitual residence apply.

Information on any additional guarantees and their precise conditions that may apply can be found next to the product and on specific information pages in the shop, if applicable.

Complaints can be submitted using Marketiger's contact details.

When a Customer exercises their statutory warranty rights and Marketiger deems it necessary to receive the goods back in order to examine the complaint, the Customer must return the goods at Marketiger's cost to the address provided for this purpose.

Marketiger is committed to responding to any complaint immediately, but no later than within 14 days of its submission.

When purchasing goods, the statutory warranty period is at least two years. For goods sold to Consumers with their habitual residence in Spain, this statutory warranty is extended to three years.

Please also refer to the harmonized notice pursuant to Implementing Regulation (EU) 2025/1960 regarding warranty rights for goods (the so-called “guarantee label”).

Guarantees and Customer Service

Information on any additional voluntary guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop, if applicable.

13. Retention of Title

The products remain the property of Marketiger until full payment has been made.

14. Intellectual Property

The Customer retains any intellectual property rights it holds in photographs, images, models, designs, textures, artwork and other files or content submitted to Marketiger.

By submitting files or other content, the Customer grants Marketiger the rights necessary to process, transform, technically modify, reproduce and manufacture from such content for the purpose of providing the Services.

This may include automated or AI-assisted processing by Marketiger or its service providers, production preparation, creation of production files, manufacturing, quality control and fulfilment.

The Customer confirms that it has all rights, licenses, consents and permissions necessary to submit the files or content and to have them processed, transformed and used for the manufacture of the requested products.

This includes any necessary rights relating to third-party intellectual property or other protected content contained in the submitted material.

Marketiger does not verify or determine ownership of intellectual property rights in content submitted by the Customer.

Marketiger may refuse, suspend or cancel files or orders that it reasonably believes are unlawful or infringe third-party rights.

To the extent permitted by applicable law, the Customer is responsible for third-party intellectual property or other rights claims resulting from files, content or instructions supplied by the Customer or from products manufactured at the Customer's request based on such material.

All rights relating to Marketiger's own software, Marketiger HUB, API, documentation, manufacturing systems, workflows, processes, production methods, AI-processing methods and know-how remain the property of Marketiger or its licensors.

15. Confidentiality

Marketiger will treat non-public Customer photographs, images, models, designs and production files as confidential and use them only as reasonably necessary to provide the Services.

Access may be provided to Marketiger employees, contractors, suppliers or service providers where reasonably necessary to perform the Services and subject to appropriate confidentiality protections.

Marketiger will not knowingly disclose Customer content or production files to unrelated third parties except where necessary to provide the Services, authorized by the Customer or required by law.

Where a separate confidentiality or non-disclosure agreement exists, that agreement applies in addition to these Terms.

16. File Storage and Privacy

Customer photographs, images, models and related files may be stored as reasonably necessary for processing the order, manufacturing, quality control, customer service and, where applicable, facilitating future orders or reorders.

Temporary or intermediate production data may be deleted when no longer reasonably required.

Marketiger does not guarantee indefinite storage unless expressly agreed. Customers should maintain their own copies of original files.

Marketiger processes personal data in accordance with its Privacy Policy.

17. Website and Online Systems

Customers are responsible for keeping any account credentials secure and for activity performed through their accounts.

Customers may not gain or attempt to gain unauthorized access, circumvent security measures, interfere with Marketiger systems or use them for unlawful purposes.

Marketiger may temporarily suspend access for maintenance, security, suspected misuse or legal compliance and does not guarantee uninterrupted or error-free availability of its online systems.

18. Liability

Marketiger is liable without limitation where liability cannot legally be excluded or limited, including where required by applicable law in relation to death or personal injury, intentional misconduct or gross negligence.

Otherwise, to the extent permitted by applicable law, Marketiger is not liable for indirect or consequential damages, loss of profit, loss of revenue, loss of business or loss of opportunity arising from the Services.

To the maximum extent permitted by applicable law, Marketiger's aggregate liability arising from an individual order or Service is limited to the amount paid or payable to Marketiger for the order or Service giving rise to the claim.

Marketiger is not liable for damage resulting from improper handling or use contrary to the intended purpose or restrictions stated in these Terms.

Nothing in these Terms limits or excludes mandatory statutory rights or liability that cannot legally be limited or excluded, particularly mandatory rights available to Consumers.

19. Force Majeure and Suspension

Marketiger is not liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, war, government action, strikes, transport disruption, energy or communications failures, cyber incidents, material shortages or disruption affecting critical suppliers or logistics providers.

Marketiger will use reasonable efforts to minimize the effects. Inability to pay does not constitute force majeure.

If a force majeure situation lasts, or can reasonably be expected to last, for more than 60 days, either party may terminate the affected agreement in writing.

Marketiger may suspend an order, Service or system access in case of non-payment, material breach, unlawful or infringing content, system misuse, security concerns or where required for legal compliance.

Mandatory Consumer rights remain unaffected.

20. Consumer Dispute Resolution

In order to settle disputes arising from a contractual relationship with a Consumer, or concerning whether such a contractual relationship exists, Marketiger is willing to participate in dispute settlement proceedings before a consumer dispute resolution body.

The Universalschlichtungsstelle des Bundes am Zentrum für Schlichtung e.V. is responsible for providing information and referring Consumers to the appropriate entity for alternative dispute resolution.

21. Governing Law, Applicable Consumer Rights and Contact

These Terms and agreements with Marketiger are governed by Dutch law.

This choice of law does not deprive Consumers of mandatory protections afforded to them by the law of the country in which they have their habitual residence where those protections apply.

Consumers retain any mandatory jurisdiction rights applicable to them.

The version of these Terms in effect when an order is concluded applies to that order.
